So here's another question. How much was the rod? If its a $1000 rod I think you have a legit beef. If its a $20 rod then fish it hard. Your still right for being pissed regardless but I think your going to make your case the higher the cost.
These things are finished like cars and a light scratch should be easily buffed out. Make your case to the shop AND the manufacturer. Let them figure out who is going to fix it.

I buy something new I would expect it in perfect shape. I want to be the guy who puts the signs of wear on my rod, so I would not be happy at all. Just my 25 cents worth

Guess it just depends on if the shipping cost is worth having not scratches. If they are just cosmetic I'd just fish it. Like others have said, I'd have scratches in it the first day. I fall down off the river at least once per outing. When I do I toss the rod to the side so I don't end up landing on it. Guaranteed scratches though!

Read the purchase agreement. You may have to pay the return shipping.

I'm always excited to fish a new rod and I'd hate to lose the couple of weeks it would take to return the rod and get a replacement. A minor cosmetic issue wouldn't be worth losing the time enjoying the rod. That being said, if you decide to return it, they ought to cover the shipping.
